The work

Professional liability

Professional liability concerns allegations that your management services caused a financial loss. The service definition is central to whether the policy addresses the work in question.

What the review should address

  • Whether the stated services include your leasing and management activities
  • The retroactive date and reporting terms when changing policies
  • How defense expenses affect the available limit
  • Contractual promises that go beyond the insured professional duty

Where the wording matters

Property damage and bodily injury can sit outside a professional liability form. Nor does accepting an obligation in a management agreement automatically bring that obligation within coverage.

Have these facts ready

  • A description of services by agreement
  • Current policy and endorsement names
  • Prior coverage dates and known disputes
